1. Operator, effective date and scope
These Terms govern HOSTuvo from 2026-09-16. For purposes of the Service and these Terms, the Operator is HOSTuvo. The primary electronic contact for support, complaints and contractual notices is admin@hostuvo.com. HOSTuvo is not an exchange, broker, custodian or bank and does not claim regulatory approval merely because these Terms are published.
These Terms cover the public website at hostuvo.com, the web application at app.hostuvo.com and expressly included HOSTuvo data interfaces. They do not govern a separate account or contract that a user may have with an exchange, wallet provider, bank, payment provider or another third party. Where mandatory law requires additional identifying or registration particulars in a specific transaction, invoice or checkout, those particulars form part of the applicable transaction information.

2. Definitions and interpretation
Service means the analytical software, informational pages and functions expressly made available for the selected account. Account means an individual access identity. FREE means a free access tier; PRO means the paid scope described before purchase. A Subscription is recurring access for a specified billing period, not ownership of the software, a deposit, a crypto-asset or a managed investment.
Output includes charts, scores, rankings, alerts, research findings, reports and explanatory text. A Consumer is a person protected as a consumer by applicable law; protections also extend to a business individual where mandatory law grants equivalent rights. Merely issuing an invoice or supplying a business identifier does not eliminate those rights. Working days, where used for operational estimates, exclude Polish statutory holidays; statutory deadlines are calculated under the law that governs them.
3. What is supplied and what is not
The Service supplies access to market information and tools for independent analysis. Features may include a spot-market scanner, order-flow context, multi-timeframe charts, model diagnostics and reports. Availability of a feature is distinct from availability of fresh source data or a qualifying signal. A ranking may contain fewer than ten entries; no entry is preferable to manufacturing a result. A subscription buys the stated access, not a minimum number of profitable opportunities.
The current service does not automatically execute real-money orders or accept assets for custody. A software signal is not an instruction received by an exchange, and a report is not evidence that a transaction took place. Do not send trading capital, seed phrases or withdrawal credentials to HOSTuvo. Any future brokerage, custody, portfolio-management or execution service requires a separate legal assessment, disclosures, permissions and terms before activation.
4. Analytical information and regulated advice
The intended scope is analytical information, not personalised investment, legal, tax or accounting advice and not an assurance that a particular transaction suits a person's circumstances. The Operator does not undertake, through this contract, to assess income, liabilities, investment experience, loss-bearing capacity or individual suitability. Before a consequential decision, obtain appropriate independent advice where needed and assess the source information yourself.
This description cannot override the substance of a feature. Personalised recommendations about crypto-asset transactions may constitute advice under Article 3(1)(24) of MiCA; providing regulated services can engage the authorisation conditions in Article 59. Financial instruments can fall under a different financial-services framework. Merely displaying a disclaimer, charging for software or asking the user to acknowledge risk does not create an exemption. Features using a user's holdings or proposed capital to recommend specific transactions require regulatory review before being presented as outside regulated advice.

5. Reading labels, alerts and model status
BUY, SELL, HOLD, authorised, candidate and similar labels describe an algorithm's state under stated input assumptions. In this analytical scope, authorised means that internal model checks have passed; it is not a regulatory approval, an exchange authorisation or a guarantee of a suitable trade. A SHADOW, research, warming-up or unavailable label must not be interpreted as a validated instruction. Scores and confidence labels are not calibrated probabilities unless the displayed methodology expressly demonstrates that interpretation.
Different modules can disagree because their time horizons, venues or data windows differ. A five-minute timing observation must not be substituted for a daily strategy. An old screenshot, notification or cached ranking may no longer represent current conditions. Check the instrument, venue, quote currency, timestamp, source quality and assumptions before using an output. The Operator must make material limitations reasonably clear rather than relying on this document to excuse misleading presentation.
6. Crypto-asset and execution risks
Crypto-asset prices can fall sharply and a position can lose its entire value. Liquidity, exchange solvency, custody arrangements, network failures, token concentration, fraud, cyber incidents, delistings and restrictions can affect the ability to sell or withdraw. A stablecoin label does not eliminate depegging, redemption, counterparty or legal risk. Different tokens sharing a symbol are not necessarily the same asset. Tax treatment and exchange access depend on the user's actual circumstances and jurisdiction.
Displayed targets are scenarios, not receivables owed to the user. Spread, fees, slippage, partial fills, latency, minimum order size and currency conversion can turn an apparent gain into a loss. Stop prices and exit alerts do not guarantee execution. The analytical subscription is not insurance, capital protection or a loss-reimbursement scheme. These warnings identify market risk; they do not waive remedies for the Operator's own unlawful conduct or defective supply.
7. Historical, simulated and AI-generated results
Backtests, replays, paper trades and hypothetical examples must be distinguished from actual executed transactions. They may omit unavailable historical order-book conditions and may be affected by selection, survivorship, overfitting or hindsight. An illustrative amount, percentage or time-to-target is not a promised return. Positive historical performance does not establish that future performance will be positive. Research activity, a large number of indicators and frequent retraining do not by themselves demonstrate investment effectiveness.
Automated language models can produce incomplete explanations, unsupported inferences or translation errors. A polished explanation is not evidence that a market prediction is correct. Material corrections should identify the affected output and revision where feasible. Subscriptions do not purchase a promise that the system will become autonomous, outperform competitors or continuously improve. Such statements must be substantiated and accurately scoped before they form part of a public offer.
8. Source data, external services and links
Market inputs can originate from third-party venues and public interfaces. Bybit.com and Bybit.eu are separate data and access contexts; a displayed symbol or price does not prove availability for a particular user. Third-party sources may change methods, restrict requests or stop responding. The Operator should identify source limitations and should not silently present substituted data as native execution data. The user must not assume a website ticker is the price at which an order will be filled.
Opening an external link can create a separate relationship under that provider's terms. Logos and asset names do not establish partnership, endorsement or a guarantee. Paid placements, affiliate relationships and material conflicts, if introduced, must be disclosed where they influence presentation. Third-party involvement does not remove the Operator's responsibility for its own contractual obligations, selection of suppliers or misleading claims.
9. Eligibility and account formation
The Service is intended for adults with capacity to enter the contract, and for representatives authorised to bind a business. An eighteen-year age condition is a contractual requirement, not a representation that every visit is subject to documentary age verification. Registration requires a working email address, the requested display name and a password meeting the displayed security requirements. Confirmation emails and account-security steps are distinct from agreeing to marketing.
These Terms are made available before or alongside account and paid-service flows and may be saved by the user. Creation of a FREE account does not by itself create a paid subscription. A paid order is formed only through an unambiguous payment process identifying the service, price and recurring obligation. HOSTuvo records the applicable version where technically implemented and provides confirmations required by mandatory law without collecting unnecessary personal data.

10. Account security and misuse
Use a unique password and protect email access and session cookies. Do not share credentials, impersonate another person or disclose another person's private information. Report suspected account compromise promptly through the verified contact published in HOSTuvo notice. Support must not request a seed phrase, a complete payment-card security code or an exchange withdrawal credential. Users should review account activity and revoke unrecognised sessions where those controls are available.
Responsibility is assessed according to each party's conduct and applicable law. The user is not automatically liable for every action recorded against an account, and the Operator is not excused from reasonable security duties by requiring a password. Where access must be restricted to contain an incident, restrictions should be proportionate, reviewed and explained unless disclosure would create a security risk or be prohibited by law.
11. Technical requirements and compatibility
The browser service requires an internet connection, a supported browser with JavaScript, and storage necessary for authenticated sessions. Device settings, network filters, content blockers, low-power modes and browser background restrictions can affect refreshing, sound and animations. Mobile controls should remain usable without requiring continuous automatic motion. The user bears ordinary connectivity and device costs, unless a particular cost is included in the offer.
Technical requirements and known material incompatibilities should be disclosed before purchase and updated when they change. The Operator must not use a generic compatibility warning to avoid delivering promised functionality on a supported device. An installation, update or troubleshooting instruction must not require unsafe security settings or unrestricted remote access to the user's device.
12. Licence, intellectual property and API
The licence is a non-exclusive, non-transferable right to access the Service for the user’s own analysis, within the purchased scope and published technical limits. It does not transfer source-code ownership or rights to resell market feeds. A separately offered Data API may permit programmatic use under its documented limits; a blanket prohibition on automation does not override an API function expressly supplied for automated access. Publication, redistribution and commercial embedding require the rights applicable to the relevant material and source data.
Do not remove attribution or bypass access controls to extract protected material. Statutory exceptions, lawful interoperability work, criticism, complaints and evidential screenshots remain unaffected. Rights in third-party libraries and assets remain with their licensors and are governed by their applicable licences; these Terms do not withdraw open-source rights. Market facts as such are not claimed as HOSTuvo’s exclusive intellectual property.
13. User entries, reports and records
A manually marked position, favourite symbol or hypothetical amount is user input, not a verified brokerage record. The user should avoid entering unnecessary financial or personal information and should keep independent records of actual transactions and tax obligations. Saving a report does not certify its accuracy or turn a scenario into advice appropriate for a particular person.
The user retains rights in their own lawful content. Any permission to process it must be limited to providing, securing and supporting the service, subject to the Privacy Policy and applicable law. There is no unrestricted licence to publish private portfolios, sell support messages or train unrelated models on account data. Mandatory rights to retrieve eligible user-provided or user-created content are preserved when a digital-service contract ends.

14. Price and paid-service order
The binding price, currency, billing interval, taxes and included scope must be shown immediately before a paid order. A promotional price or planned package on an informational page is not permission to collect an undisclosed charge. The inspected code describes one monthly PRO package; these Terms do not create additional tiers or approve payment activation. Where checkout is unavailable, the user should not pay through an alternative channel represented as a shortcut around that restriction.
Payments, where enabled, are processed through the identified payment provider rather than by sending card details to support. Exchange-rate and bank fees outside HOSTuvo’s control are distinct from the subscription charge. HOSTuvo does not use preselected optional extras, convert a free account to a paid subscription without an order, or charge an undisclosed performance fee. Required contract and payment confirmations are supplied on a durable medium where mandatory law requires them.

15. Renewal, cancellation and billing errors
If the user expressly orders recurring access, renewal occurs at the disclosed interval until cancellation. Cancellation should stop future renewals while retaining access for the period already paid, except where a refund or immediate statutory termination requires another result. The effective cancellation time, end of access and any remaining lawful payment obligation should be confirmed. A material price increase requires advance notice and a real opportunity to refuse the new price before it is charged.
The published billing portal is the preferred cancellation route where it functions. A clear cancellation notice received through the verified support channel must not be dismissed merely because a portal was not used, especially during an outage. A disputed, duplicated or unauthorised charge should be investigated. Exercising lawful chargeback or payment-dispute rights does not automatically forfeit statutory refunds or justify permanent account punishment.
16. Consumer withdrawal and early performance
Where Polish consumer distance-contract rules apply, the ordinary withdrawal period is fourteen days from conclusion of a service contract, subject to statutory rules and extensions. An unequivocal statement is sufficient; a reason is not required. The optional model statement below may be used but is not compulsory. A request for immediate commencement should be separate, informed and recorded. Proportionate payment for service supplied before withdrawal may be required only where all relevant legal conditions are met.
Starting a continuing subscription, logging in or opening a dashboard does not automatically extinguish withdrawal rights. Any exemption for fully performed services or separately supplied digital content must meet its own legal conditions and is not indiscriminately applied to every software subscription. Where applicable law requires an online withdrawal function or durable confirmation, HOSTuvo must provide the required mechanism for the relevant transaction. Cancellation of future renewal, statutory withdrawal and termination for non-conformity are different mechanisms.

17. Conformity and mandatory remedies
A paid service must meet the contractual and mandatory conformity requirements that apply to it, including the described functionality, compatibility, continuity, security and required updates. Describing outputs as uncertain is not permission to supply non-functioning software or misstate capabilities. Where digital content or a digital service is non-conforming, applicable rights can include bringing it into conformity and, when the statutory conditions are met, price reduction or termination and repayment.
An unprofitable independent trade is not, by itself, proof of software non-conformity; equally, a risk warning does not conclusively disprove a defect. Assess the actual promised feature, data available at the relevant time and the reported failure. Users may be asked for reasonable, minimally intrusive cooperation to diagnose their environment, not their secret credentials or unrestricted device access. Mandatory remedies are not limited to discretionary service credits.
18. Complaints and support
Complaints and support requests may be sent to admin@hostuvo.com. A useful complaint identifies the account or order, affected feature, approximate time, description and requested remedy; screenshots may be supplied after removing passwords, tokens and unnecessary third-party personal information. A receipt is not the only possible proof of purchase. Requests for additional information must be proportionate and must not be used to postpone statutory deadlines improperly.
Where the Polish Consumer Rights Act governs and no special provision changes the period, a consumer complaint requires a response within fourteen days; the legal consequences of failing to respond remain intact. A response should be understandable and delivered on a durable medium. Security reports and personal-data requests may follow separate procedures. A dissatisfied user may pursue competent consumer assistance, ADR where available or court remedies without first accepting a confidentiality waiver.
19. Maintenance, updates and service changes
No uninterrupted market feed or error-free prediction is promised. The Operator nevertheless remains responsible for the level of service actually contracted and required by law. Planned work should be notified where reasonably practicable; urgent security work may occur without advance notice. For a material prolonged loss of paid functionality, the Operator must assess repair and any legally required reduction, termination or refund rather than relying solely on an availability disclaimer.
Changes to a continuing digital service must have a valid contractual basis and comply with mandatory change rules. Material adverse changes should be explained in advance on a durable medium, including any right to end the contract or retain an unchanged version where applicable. A feature labelled experimental is not automatically exempt from consumer protection when it formed a material part of the paid offer.

20. Prohibited conduct
Do not attack service availability, bypass authorisation or rate controls, steal credentials, introduce malware, impersonate staff, redistribute restricted account access or use unlawfully obtained data. Do not use the service to facilitate fraud, market manipulation or breaches of applicable sanctions. Legal public research, good-faith vulnerability reporting and exercising consumer or data-protection rights are not prohibited merely because they are inconvenient to the Operator.
A good-faith security report should avoid accessing unrelated accounts, retaining more data than necessary or disrupting production. Permission to investigate must not be inferred from this clause. Any recovery of losses caused by a user's unlawful conduct is limited to a demonstrable legal entitlement, with causation, fault and procedural protections assessed under applicable law; there is no automatic unlimited indemnity for every allegation by a third party.
21. Suspension and termination
Restriction may be justified by a verified security incident, a material contractual breach, an enforceable legal requirement or non-payment of a valid charge. Where practical, the user should receive reasons, a reasonable opportunity to correct a remediable breach and a route to challenge an incorrect restriction. Immediate action is reserved for situations where delay would reasonably risk harm or violate law. Automated flags should not become an irrebuttable conclusion.
The Operator must not terminate a paid account arbitrarily while retaining all prepaid fees. When the Operator permanently discontinues a paid service without a user breach justifying that result, unused prepaid access should be settled in accordance with the contract and mandatory law. Account deletion and subscription cancellation must be coordinated so deletion does not conceal continuing billing. Lawful retention of limited evidence is addressed separately in the Privacy Policy.
22. Liability: mandatory carve-outs
Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded, including mandatory consumer remedies, intentional wrongdoing, fraud, liability for personal injury where protected, or data-protection rights and compensation. For consumer users, no general monetary cap is imposed by this document. The absence of a return guarantee does not excuse deceptive advertising, concealment of material limitations or failure to supply the agreed digital service.
A user's own trading decision, a third-party market event and a defect attributable to the Operator are different issues. Liability depends on the applicable legal basis, actual damage, causation and any legally relevant contribution to the loss. It is not presumed either that the Operator reimburses all market losses or that the user bears every loss regardless of fault. Contractual language does not bind regulators or prevent a competent court from assessing the actual facts.
23. Separate business-only allocation of risk
Only for a business customer without applicable consumer-equivalent protection, the aggregate contractual cap for ordinary negligence is the greater of the fees paid for the affected service in the preceding twelve months or USD 100, to the extent such a cap is lawful. Within that same lawful business-only scope, speculative lost trading profits and indirect consequential losses are excluded. This is a contractual allocation of ordinary commercial risk, not a statutory limit and not a representation that every jurisdiction will enforce it.
The cap and exclusions do not cover intentional wrongdoing, fraud, gross negligence, personal injury, mandatory digital-service or data-protection liability, or any other non-excludable liability. An individually negotiated business agreement may specify a different allocation. No clause creates a consumer arbitration waiver, limits regulator powers or converts a protected individual into an unprotected business customer.
24. Cross-border use and financial regulation
A language version, country suggestion or ability to open a website is not a licence to offer every function in every country. HOSTuvo may restrict access where law, sanctions, licensing or provider rules require it. Users must not evade a lawful restriction with a false location or identity; that obligation does not transfer HOSTuvo’s own compliance duties to them. HOSTuvo does not claim registration, licensing or endorsement by the KNF, ESMA, FCA, SEC or another authority unless a specific current notice expressly states otherwise.
EU crypto-asset services, financial-instrument services and public investment recommendations may engage different rules depending on their substance. UK cryptoasset financial-promotion rules can apply to communications directed to UK consumers even from overseas. US and other national securities, advisory, consumer and privacy rules require their own scope assessment. Neither the phrase educational use nor a statement that the user acted on their own initiative can manufacture a legal exemption where the facts do not support it.
25. Applicable law, courts and redress
Unless mandatory rules require another result, these Terms are governed by Polish law. This choice does not deprive a consumer of mandatory protection available under the law that would apply without the choice. In EU cross-border consumer matters, Article 6 of Rome I and the consumer-jurisdiction rules of Brussels I bis remain applicable. A consumer is not required by these Terms to litigate exclusively in HOSTuvo’s home forum where mandatory jurisdiction rules provide otherwise.
No mandatory pre-dispute arbitration or blanket class-action waiver is imposed. A complaint to a regulator or a lawful court claim remains available. ADR may be used where the competent procedure and required participation conditions permit it. The discontinued EU Online Dispute Resolution platform is not presented as an active complaint channel; current consumer-assistance and dispute-resolution directories should be used instead.
26. Amendments, language and severability
These Terms state their version and effective date and should be archived when replaced. Material contractual changes require an identified reason, appropriate advance notice and any consent or termination opportunity required by law. The ordinary notice period for a material adverse change is at least thirty days where reasonably practicable, except where a shorter period is objectively necessary for mandatory law or urgent security; no exception permits retrospective removal of accrued rights or undisclosed charges.
English is the drafting source and Polish is an aligned version, without waiving language-specific consumer protections. Unreviewed machine translations must not be presented as authoritative legal versions. Ambiguities affecting a consumer are interpreted under the protective rules of applicable law, not automatically in HOSTuvo’s favour. If a provision is ineffective, mandatory law applies and the remaining provisions continue to the extent lawful.
27. Optional withdrawal statement and contact
Suggested statement: I notify HOSTuvo that I withdraw from my contract for the following HOSTuvo service: [service or order identifier]. Contract date: [date]. Account email: [email]. Name: [name]. Date of this statement: [date]. Send the statement to admin@hostuvo.com or use another withdrawal mechanism displayed for the relevant order. Add a signature only where a paper statement is used. Use of this model is optional; an unequivocal withdrawal statement is sufficient where the law so provides.
Questions, complaints and contractual notices may be sent to admin@hostuvo.com. HOSTuvo maintains these Terms as a risk-allocation and transparency framework; no document can guarantee protection against every claim, investigation, market loss or later change of law. Mandatory rights and regulatory powers remain unaffected.
